Consent: Processing for optional purposes such as marketing communications and personalised promotions, where you have given explicit, informed consent that you may withdraw at any time

Withdrawing consent: Where processing is based on your consent, you may withdraw that consent at any time by contacting our support team or updating your communication preferences in your account settings. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

06 Data Sharing & Disclosure

16phlove does not sell, rent, or trade your personal data to any third party for commercial purposes. We may share your personal data only in the following limited circumstances:

6.1 Service Providers

We engage trusted third-party service providers who process personal data on our behalf under strict data processing agreements. These include KYC and identity verification providers, payment processors (GCash, PayMaya, and banking partners), cloud hosting and infrastructure providers, customer support platform providers, and fraud detection and cybersecurity vendors. All service providers are contractually bound to process your data only as instructed by 16phlove and in compliance with the Data Privacy Act.

6.2 Regulatory & Legal Disclosure

16phlove may disclose personal data to PAGCOR, the Anti-Money Laundering Council (AMLC), the National Privacy Commission (NPC), law enforcement agencies, or courts of competent jurisdiction where required by Philippine law, a valid court order, or a lawful regulatory request. We will notify you of such disclosures where legally permitted to do so.

6.3 Business Transfers

In the event of a merger, acquisition, or sale of all or substantially all of 16phlove's assets, your personal data may be transferred to the acquiring entity, subject to the same privacy protections described in this Policy. You will be notified of any such transfer via email or a prominent notice on the Platform.

6.4 Cross-Border Transfers

Some of our service providers may be located outside the Philippines. Where personal data is transferred internationally, 16phlove ensures that appropriate safeguards are in place, including contractual clauses that meet the standards required by the NPC, to protect your data to a standard equivalent to that provided under Philippine law.

07 Data Retention

16phlove retains your personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable Philippine law. The following retention periods apply:

Account and KYC data: Retained for a minimum of five (5) years from the date of account closure, as required by PAGCOR licensing conditions and the Anti-Money Laundering Act
Transaction records: Retained for a minimum of five (5) years from the date of each transaction, in compliance with AMLA reporting obligations
Customer support records: Retained for three (3) years from the date of the last interaction
Marketing consent records: Retained until consent is withdrawn, plus one (1) year thereafter as evidence of consent
Technical and device logs: Retained for twelve (12) months from the date of collection, unless required for an ongoing investigation

Upon expiry of the applicable retention period, personal data is securely deleted or anonymised in accordance with NPC guidelines. Anonymised data may be retained indefinitely for statistical and analytical purposes.

08 Data Security

16phlove implements industry-standard technical and organisational security measures to protect your personal data against unauthorised access, disclosure, alteration, or destruction. Our security measures include:

Your role in security: You are responsible for keeping your 16phlove login credentials confidential. Never share your password with anyone. 16phlove staff will never ask for your password via any channel.

Note on erasure requests: While we respect your right to erasure, certain personal data must be retained for a minimum of five (5) years under PAGCOR licensing conditions and the Anti-Money Laundering Act. We will inform you of any such limitations when processing your erasure request.

11 Children's Privacy & Age Restriction

The 16phlove Platform is strictly intended for individuals who are 21 years of age or older, in accordance with Philippine gambling regulations. We do not knowingly collect personal data from individuals under the age of 21.

If we become aware that personal data has been collected from a person under 21 years of age, we will immediately suspend the associated account, delete the personal data collected, and return any deposits to the payment method used, subject to verification. If you believe that a minor has registered on the 16phlove Platform, please contact us immediately at the details provided in Section 13.

16phlove employs age verification procedures during registration and KYC processes specifically to prevent underage access to the Platform.

12 Changes to This Privacy Policy
